4月14日，记者获悉，湖北周黑鸭企业发展有限公司一纸诉状分别将2家宿州“周黑鸭”的经营者告上合肥市中院，分别索赔经济损失10万元。今年1月初，宿州2家“周黑鸭”店被国家食品药品监督管理总局通报称含有罂粟壳成分，引起社会广泛关注，湖北周黑鸭在这一事件中“躺枪”，后发表声明称周黑鸭尚未进入安徽市场。

　　分别向两个经营者索赔10万元

　　4月14日，湖北周黑鸭代理律师杨轶告诉记者，合肥市中院已经受理湖北周黑鸭起诉宿州2家“周黑鸭”经营者侵权的案子。

　　记者了解到，被告黄某今年40岁，系原宿州市埇桥区慧鹏周黑鸭经营店（现已注销）负责人。被告武某今年32岁，系原宿州市埇桥区菊记周黑鸭店（现已注销）负责人。

　　在诉状中，湖北周黑鸭要求两被告停止侵害原告享有的周黑鸭商标专用权，分别向原告赔偿损失及维权合理支出共计10万元，并承担本案的诉讼费用。

　　杨轶律师介绍，湖北周黑鸭系7936086号“周黑鸭”文字及图组合商标的权利人，且被国家工商行政管理总局商标局认定为驰名商标。

　　今年1月20日，国家食品药品监督管理总局发布通告，其中两被告因存在涉嫌违法添加行为被通报。在诉状中，湖北周黑鸭方面认为，从媒体报道、转载情况看被告的这种使用容易且实际导致了消费者混淆。湖北周黑鸭认为，两被告将原告驰名商标作为字号登记注册，同时在其经营的熟食店门头及食品包装袋上，擅自使用与涉案商标相同或相近的商业标识，属于在相同商品上的商标性使用。据此，湖北周黑鸭认为，被告的行为已经构成了侵犯注册商标专用权，请求法院判如所请。

　　事隔3个多月，在湖北周黑鸭新闻发言人郝立晓看来，年初的“毒鸭”事件给周黑鸭的品牌美誉度带来了巨大伤害，“很多消费者误以为是我们的店，我们的店员不得不反复作出解释”。

　　郝立晓说，事件发生后，安徽当地工商部门对涉嫌侵权的门店进行了相应处置。他们希望，工商主管部门能够在企业名称登记核准时，避免用别人的注册商标登记为门店名称。

　　此前，周黑鸭曾多次在安徽市场打假维权，但至今尚未将店面开到安徽。对于何时进入安徽市场，郝立晓透露，有望在今年年底进入安徽合肥。“今年5月份前后，周黑鸭的新工厂投产，增加的一部分产能能够满足进入安徽市场的需要。”郝立晓说，周黑鸭在江浙沪均已布局门店，这些地区有很多来自安徽的消费者，他们比较喜欢周黑鸭的口味。“可以预见，安徽的消费者会喜欢周黑鸭的口味，为了确保质量安全和品质的稳定，我们会在准备好之后进入安徽。”
