“上了大半年班，单位却一直拖欠工资，还说退休人员再打工不受劳动法保护，怎么办？”近日，南京玄武法院里来了一位“超龄打工者”，就欠薪问题咨询求助。

　　倪先生年过六旬，去年4月经人介绍进入雨花台区一家老年公寓做杂务，每月工资2000元，双方只是口头约定，并未签订书面合同。后因单位另一名护工请假，倪先生便临时担任“护工”职责。“上任”没几天的一个凌晨，倪先生在老年公寓内死亡，死亡原因为心源性猝死。

　　认为丈夫猝死应当算“工伤”，倪先生的老伴与老年公寓协商未果后，经人指点诉至雨花台区劳动争议仲裁委员会，要求确认双方劳动关系。劳动仲裁部门认为，倪先生已达法定退休年龄，不再受《劳动合同法》保护，建议她通过法律途径，向人民法院提起诉讼来维权。

　　记者从多个基层法院了解到，在立案庭导诉台，时常有“超龄打工者”前来咨询欠薪、工伤等问题，市中院民五庭此前也二审受理了江宁、鼓楼、雨花台等地“超龄打工者”就确认劳动关系、索要加班工资等提起的诉讼。

　　根据《劳动合同法实施条例》第21条，“劳动者达到法定退休年龄的，劳动合同终止”，超过退休年龄者并不是法律意义上的劳动者，不受《劳动合同法》保护。此外，最高人民法院司法解释也明确，对于退休人员再就业，已享受养老保险待遇的，用人单位与其之间不属于劳动关系，不受劳动法保护。

　　近日，玄武法院接待了这样一名咨询者，57岁的赵女士退休后应聘到一家公司做会计，上了大半年班后却遭遇欠薪，她与对方沟通时，得到的结论却是“不存在劳动关系，找仲裁也没用”。赵女士说，自己打听了一下才知道，这家公司以此借口招退休人士“再就业”，拖欠工资的情况不在少数，自己也不是第一个被“坑”的员工。

　　一名审理劳动争议案件的法官告诉记者，在现实中，确实存在部分雇主以“不是劳动者”为名，招聘退休人员却拖欠工资的情况。法官提醒说，“超龄打工者”就业时虽然无法签订劳动合同，但可主动签订劳务协议，明确工作内容、报酬、医疗、劳动保护待遇等权利义务，双方构成“劳务关系”。一旦发生纠纷，打工者可按照《合同法》中的规定维护自身权益。
