近日，西安一中学在重雾霾天违规补课，一学生向教育局举报后却遭“报复”，被老师批评，引起网络热议。10日，陕西省教育厅和西安市教育局官方微博对学校“报复”投诉学生一事作出回应，确认是西安碑林区教育局一名干部私自将举报者电话转给学校的学籍管理员。

　　学生举报遭“报复” 举报人频“被裸奔”

　　日前，社交平台“知乎”上一篇名为《你感到最憋屈的事是什么》的贴文广泛传播，帖文称1月4号，雾霾指数达到500加，“脱下口罩呼吸都觉得有杂物”，学校却重雾霾天违规补课，一个同学给教育局打电话举报了这件事，“结果万万没想到教育局把举报者的电话号码直接给了学校了”，遭到学校领导的训斥。

　　对于教育局领导泄漏举报学生一事，许多网友表示这种行为侵害了学生的隐私权和监督权，网友“小水微澜”说：“雾霾天是否停课可以商榷，但泄露举报学生信息这种事应该严查，举报人信息应该列入国家机密，泄露者应该追究刑责。”还有很大一部分网友对目前“谁举报，报复谁”的现状表示忧虑，关心举报人的安全如何保障？

　　事实上，无论哪个领域，举报人个人信息被泄漏，利益受损都并非个例，其中让人印象深刻的莫过于深圳沃尔玛洪湖店的“黑油”事件。2014年，举报人通过视频举证该店煎炸用油“一个月不换”，以及涉嫌用过期肉等原材料制作熟食等问题。由于举报者个人信息被泄漏，一个多月后，沃尔玛对举报人作出了解聘的决定，解聘缘由为其行为“严重违反公司规章制度，同时给公司造成重大损害”。曾一度引起关于完善立法制度保护举报者的探讨。

　　2015年，河北唐山市民致电唐山市交警支队，实名举报一协警开套牌车。结果举报信息被泄漏，举报当天该市民便遭到被举报人电话恐吓，收到被举报人450通电话轰炸。

　　2016年，环保监察大队长泄漏举报人信息被清出环保队伍。一群众向中央督察组副组长、环保部副部长翟青举报称，大厂县西马庄村村南石料厂污染严重，向当地环保部门举报此事，但他的个人信息却被泄露给了污染企业，并由此受到企业威胁。慑于调查压力，大厂县环保局监察大队长王铁军主动承认是其泄露举报人信息。

　　被“隐性报复”了？ 教你如何维权

　　可以说，在当前举报机制还不健全的背景下，举报人信息被泄漏而遭受这种“隐性报复”的事例不一而足。如何才能避免举报人被“裸奔”，用法律保护举报人，为举报人撑起一把“保护伞”？

　　目前，对于举报人进行保护的相关法律法规散见于《行政监察法》、《刑法》、《最高人民检察关于保护公民举报权利的规定》、《关于保护、奖励职务犯罪举报人的若干规定》等。

　　《行政监察法》第四十六条规定，泄露举报事项、举报受理情况以及与举报人相关的信息的，依法给予处分；构成犯罪的，依法追究刑事责任。

　　《刑法》第二百五十四条规定，国家机关工作人员滥用职权、假公济私，对控告人、申诉人、批评人、举报人实行报复陷害的，处二年以下有期徒刑或者拘役；情节严重的，处二年以上七年以下有期徒刑。

　　此外，为进一步维护举报人的合法权益，2016年3月30日，最高人民检察院、公安部、财政部联合印发了《关于保护、奖励职务犯罪举报人的若干规定》。

　　《规定》明确了谁来保护举报人？举报人及其近亲属的保护主要由人民检察院负责，检察院在开展保护举报人工作中，需要公安机关提供协助的，应当商请公安机关办理，公安机关应当在职责范围内予以协助。另外，如果举报人直接向公安机关请求保护而又必须采取紧急措施，公安机关应当先采取紧急措施，并通知受理举报的检察院。

　　同时还列出三类保护措施保护举报人：一是举报人及其近亲属人身、财产安全受到威胁的，应当采取禁止特定人员接触举报人及其近亲属，对举报人及其近亲属人身、财产和住宅采取专门性保护措施等；二是举报人及其近亲属因遭受打击报复受到错误处理的，应建议有关部门予以纠正；三是举报人及其近亲属因遭受打击报复受到严重人身伤害或者重大财产损失的，协调有关部门依照规定予以救助。
