随着2015年网络文学IP的盛行，越来越多的网络文学被改编成影视剧。但是，前不久，《鬼吹灯》的作者天下霸唱通过律师发表声明，表示自己拥有全部作品完整的著作权，任何机构和个人未经允许均不得肆意修改或改编。最近，蒋胜男与《芈月传》制片方的纠纷，再一次让我们看到，网络作家在影视改编中的地位，原来只是“看上去很美”。
　　2015年4月，蒋胜男控告《芈月传》制片方著作权侵权，该案至今仍未开庭审理；2015年11月20日，制片方起诉蒋胜男在电视剧开播前，提前出版小说，涉嫌违约。双方各执一词，互不退让。
　　《芈月传》的维权纠纷，作家圈里人都作如何想？出版人路金波认为，“就《芈月传》的维权纠纷来看，制片方答应和蒋胜男合作，给她钱，而她在答应之余，有两件事情没有做。第一是她没有把小说发表在网上。第二，她写完小说后没有去单独做一个小说的著作权登记。对于网络作家，我的建议是，不要迷信任何机构，不要被商业利益迷惑。你们可以回到网络文学的最初状态——在网上进行连载，所有写作者都是平等的。”
　　网络文学评论家夏烈认为，网络作家在生态链中最容易被“吃掉”，因为他们是最底端的。蒋胜男在这场纠纷中所披露出来的问题，恰恰就是原创的写作者受到资本和产业压迫的实例。他建议，“网络作家，最好还是在作品已经完结的情况下，再去做版权的转让。不要在创作之初或之中，就去和下游的影视公司签订各种有细节漏洞的合同。《甄嬛传》的编剧流潋紫之所以没太吃亏，就是因为谈改编时，已经出书了，人家绕不过去的，而这也是蒋胜男特别弱势的地方。所以教训就是，你不要没写完，就急着把作品卖了。”
