　　补充协议具有什么效力？

　　业内专业人士表示，“在北京二手房交易中，买房人与卖房人签订补充协议，对二手房交易的重要事项进一步做出规定。如果补充协议条款与原合同条款不一致，或是发生冲突，应当以补充协议为准，但是原合同中明示不得变更的条款，补充协议对该条款的变更则不发生法律效力。”

　　专家认为，房屋过户、物业交割是北京二手房交易中十分重要的环节，所以双方当事人可以在补充协议中做出明确规定。补充协议可以规定过户时间、过户条件，还可以规定物业交割时间以及买房从购房款中留存多少钱作为物业交割保证金，这样可以防止双方在交易中发生纠纷。

　　如果北京二手房交易无法顺利完成，那么买卖双方当事人的责任划分问题就凸显出来。“在双方当事人签订补充协议时，要对双方当事人的违约责任做出明确规定。比如，在买房人办理二手房贷款手续时，有可能因为买房人资质不够等原因而无法获得银行批贷，导致二手房交易无法完成，那么在补充协议中要对买房人的此类违约责任做出规定。”汤正魏说。

　　在实际二手房交易中，市场行情转好，部分卖房人就会擅自提价。为了防止卖房人任意加价，买房人可以要求在补充协议中规定此类行为的违约责任。

　　如何依据补充协议维权？

　　在资深人士看来，“补充协议对于二手房交易中的重要事项都做到了明确的约定。一旦双方当事人发生纠纷，受害一方当事人可以依据补充协议，要求另一方当事人承担违约责任。”

　　“例如在市场转好的情况，卖房人擅自提高二手房价格，构成补充协议中违约行为，就要按照补充协议相关规定支付违约金。这样可以有效保护买房人的权益。”有业内人士说。
